Conditional Green Card

 

Transitioning from a 2-year Conditional Green Card

to a 10-year Permanent Green Card through Marriage

Most individuals who receive a Green Card through marriage are granted a 2-year conditional Green Card.

 

If you have this type of Green Card, you must apply for a 10-year permanent Green Card within the 3-month period starting 1 year and 9 months after receiving your conditional Green Card and ending when it expires at 2 years.

Issues with Maintaining the Marriage

In some cases, the marriage may not work out after receiving the Green Card, leading to separation or even divorce. Separation or divorce does not necessarily mean you cannot receive a permanent Green Card.

The important thing is to prove that the marriage was not entered into solely for the purpose of obtaining a Green Card. If you can gather evidence showing that the marriage was genuine, you may still be eligible for a permanent Green Card, even if you divorced shortly after receiving your conditional Green Card.
