H1B Visa

The H-1B visa is a non-immigrant visa that allows U.S. companies to temporarily employ (3 years each) foreign workers in specialty occupations.

These occupations typically require theoretical or technical expertise in specialized fields such as science, technology, engineering, or mathematics (STEM). Examples of such professions include software engineers, IT specialists, architects, accountants, professors, and medical professionals.

To qualify for an H-1B visa, the applicant must hold at least a Bachelor's Degree in the relevant field.

Procedure

 

Every year in March, applicants must register for a lottery conducted by the U.S. Citizenship and Immigration Services (USCIS). Only those selected in this lottery are eligible to apply for the H-1B visa. Recently, only about 20% of the applicants have been selected during the last several years, making it very difficult to obtain an H-1B visa.

Furthermore, even if selected in the lottery, obtaining approval for an H-1B visa can be challenging unless the applicant is employed by a relatively large company in a STEM field.

The H-1B visa is typically issued for a validity period of three years and can be extended up to a total of six years.

Spouses and children under the age of 21 can also live in the U.S. with the H-1B visa holder by obtaining an H-4 visa or status.
