Uploaded May 22, 2026 - USCIS to Limit Adjustment of Status Inside the U.S.

USCIS announced a new policy limiting the grant of adjustment of status ("AOS") as a matter of discretion inside the U.S. through USCIS.

USCIS may restrict Adjustment of Status to "extraordinary circumstances," impacting marriage & employment-based green card applications.

​Our View​

It is unclear at this time whether USCIS will apply this policy to everyone or selectively apply to certain groups from doing adjustment of status. If it is implemented 100% across the board, it will be devastating for many people. We hope it is not implemented such a way.

For now we can only guess. Perhaps it might not be implemented against high tech workers, who are mostly working with an H1B Status, their employers (Google, Amazon, Tesla, etc.) have tremendous lobbying power and they will lobby vigorously to exempt their employees. 

But individuals might not be spared. Since individuals (like people who are married to a U.S. citizen) don't have the powerful lobby like the high tech companies, they might not be exempt from this policy. The best chance these people have is that the court will block the implementation of this policy against those who have already filed a green card application with USCIS or are about to file an application within the next 90 days or so. 

In any event, there are many unknowns at the present time and we have to wait and see what unfolds.  We will update this page when major developments occur with this matter.

 Uploaded March 10, 2026 - H1B Filing Fee Update

The new $100,000 H1B fee does not apply if you apply for H1B Status with USCIS. And it does not apply if you seek an H1B stamp later with the approved petition.

 

But if you apply for a new H1B visa from abroad, you may be subject to the $100,000 filing fee.

You should consult with an immigration law attorney if you have a question about the $100,000 filing fee.
